Terms of Use

1. Agreement

These Terms are an agreement between you and Montorox LLC, 2312 1st St NW, Washington, DC 20001, USA ("Montorox", "we", "us"). They cover the Danfo Rush game on any platform and the danforush.com website (the "Service"). By using the Service you agree to these Terms and to our Privacy Policy. If you don't agree, please don't use the Service.

If you download Danfo Rush from the Apple App Store or Google Play, that store's terms also apply. Apple and Google aren't parties to these Terms and aren't responsible for the game. However, Apple and its subsidiaries are third-party beneficiaries of these Terms for apps downloaded from the App Store.

2. Who can play

You must be at least 13 years old, or the minimum age to use online services where you live, to use the Service. If you're under the age of majority where you live, a parent or guardian must agree to these Terms for you.

3. Your licence to play

We give you a personal, non-exclusive, non-transferable, revocable licence to use the Service for your own non-commercial entertainment. You may share screenshots, clips and results cards on social media, and you may stream or make videos of your play, as long as you don't suggest that we endorse you. You may not:

• copy, modify, sell, rent or redistribute the game or its art, music, voices or code;
• reverse engineer, decompile or tamper with the game, except where the law allows it;
• cheat, use bots, mods or exploits, or submit fake or altered scores;
• overload, attack, scrape or interfere with our servers or other players;
• use the Service unlawfully or to harm anyone.

4. Driver names and leaderboard

Driver names appear publicly. Don't use your full real name, other people's names, or anything offensive, hateful, sexual, impersonating or infringing. We may reject or change names, remove scores that look cheated or impossible, reset leaderboards, and suspend players who break these rules, without notice.

5. Coins, missions and garage items

Coins, rewards and garage items are part of the game. They're a limited licence, not property. They have no cash value, can't be exchanged for money or sold, and may be changed, rebalanced or reset as the game develops. Your progress is stored on your device, so uninstalling the game or clearing its data may erase it. If we offer in-app purchases in future, the price and what you get will be shown before you buy. The App Store or Google Play processes the purchase under its own refund rules, and except where the law says otherwise, purchases are final.

6. Early access

The Service is in early access. Features, routes, balance and content may change, be removed or have bugs, and the Service may sometimes be unavailable. We're grateful for bug reports at hello@danforush.com. If you send us feedback or ideas, you let us use them freely, without obligation to you.

7. A work of fiction

Danfo Rush is inspired by life in Lagos, but it's a work of fiction. Agencies such as "DASTMA", radio stations, filling stations, brands, billboards, businesses and characters in the game are invented. Any resemblance to real organisations or people is coincidental. Places and routes are stylised and aren't accurate maps.

8. Play safely

Danfo Rush is a game, not driving advice. Never play while you're driving or crossing the road, and always obey real traffic laws. Take breaks. If you've ever had seizures or epilepsy, ask a doctor before playing games with flashing lights.

9. Our content

The Service, including its art, models, music on Danfo FM, voices, text, logos and code, belongs to Montorox or its licensors and is protected by intellectual property laws. "Danfo Rush" and its logo are our trademarks. Except for the licence above, we reserve all rights.

10. Ending things

You can stop using the Service at any time. We may suspend or end your access if you break these Terms or if we stop offering the Service. Sections 5, 7, 9, 11, 12 and 13 continue after that.

11. Disclaimers

The Service is provided "as is" and "as available". To the fullest extent the law allows, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement. We don't promise that the Service will be uninterrupted, error-free or keep your progress. Some places don't allow these exclusions, so they may not all apply to you.

12. Limitation of liability

To the fullest extent the law allows, Montorox and its members, employees and partners aren't liable for any indirect, incidental, special, consequential or punitive damages, or for lost data, profits or goodwill, arising from the Service. Our total liability for any claim relating to the Service is limited to the greater of the amount you paid us in the 12 months before the claim, or US$50. Nothing in these Terms limits liability that can't be limited by law, or your rights as a consumer under mandatory local law.

13. Governing law and disputes

These Terms are governed by the laws of the District of Columbia, USA, without regard to conflict-of-law rules. Courts located in Washington, DC have exclusive jurisdiction, unless your local consumer law gives you the right to bring a claim where you live. Before starting any claim, please contact us first at hello@danforush.com so we can try to sort it out informally.

14. Changes

We may update these Terms as the Service changes. We'll update the date at the top, and for material changes we'll give reasonable notice on the site or in the game. If you keep using the Service after changes take effect, you accept them.
